• “User,” “you,” and “your” refer to any individual or entity accessing the Services.
• “Services” include dental laboratory and fulfillment services, prescription (“Rx”) processing, and the manufacture of dental products.

You agree to use the Services only for lawful purposes. You agree not to:

• Submit false, misleading, or inaccurate prescription or order information
• Use the Services to provide medical or dental advice to patients
• Attempt to gain unauthorized access to any part of the Services
• Interfere with the security or operation of the Services
• Use the Services in violation of any applicable law or regulation

Apex reserves the right to suspend or terminate access for any user who violates these Terms or applicable law.

All prescriptions and treatment decisions are made by licensed healthcare professionals. Apex Lab Group acts as a dental laboratory and manufacturer, not as a healthcare provider. We do not provide medical or dental advice, diagnosis, or treatment.

Users submitting prescriptions represent and warrant that they are licensed professionals authorized to prescribe the requested products and that all submitted information is accurate and complete.

All content, branding, designs, and materials on the Services, including text, graphics, logos, and software, are the property of Apex Lab Group or its licensors and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written consent.

You retain ownership of information you submit through the Services. By submitting prescription data, scans, or other content, you grant Apex a non-exclusive license to use, process, and store that information solely for the purpose of fulfilling orders and providing the Services.

The Services may contain links to third-party websites or integrate with third-party services. Apex is not responsible for the content, practices, or availability of third-party sites and services. Your interactions with third parties are solely between you and that third party.

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, Apex disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Apex does not warrant that the Services will be uninterrupted or error-free.

To the fullest extent permitted by law, Apex Lab Group shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our aggregate liability shall not exceed the amount you paid for the specific product or service giving rise to the claim.

You agree to indemnify and hold harmless Apex Lab Group and its affiliates from any claims, damages, or expenses arising from your use of the Services, your violation of these Terms, or your violation of any applicable law or third-party right.

Our handling of personal and health-related information is described in our Privacy Policy and HIPAA Notice, which are incorporated into these Terms by reference.

We may update these Terms at any time. We will post the updated Terms on this page and revise the “Last Updated” date. Your continued use of the Services after changes constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in McLennan County, Texas.
